This Contract has been signed between the limited liability company SIA “Kaffeks”, registration number 40203335423 (hereinafter referred to as the Company), and the Buyer who makes a purchase in the Company’s Internet Shop. By making a purchase in the Company’s Internet Shop, the Buyer confirms that he/she has familiarised himself/herself with the Distance Contract and agrees to the provisions of this Contract.
1. Subject of the Contract
1.1. This Distance Contract is an agreement between the Buyer and the Company. The Distance Contract shall apply to all the orders and purchases made in the Company’s Internet Shop.
1.2. This Contract stipulates the rights and duties of the Company and the Buyer, as well as the provisions in relation to the payment and delivery of the goods.
2. Entry of the Distance Contract into Force
2.1. The Distance Contract shall become effective from the moment when the Company received a full payment of its invoice from the Buyer.
3. The Goods and Their Price
3.1. The Company’s Internet Shop sells Nespresso® coffee capsules, coffee machines and their accessories.
3.2. The prices for the goods in the Internet Shop are provided without the delivery costs.
3.3. The purchase and delivery of the goods must be prepaid as follows:
3.3.1. as a payment of the received invoice for the goods;
3.3.2. as a payment via a credit card or via automated internet banking. Such a payment shall be provided by Worldline Latvia (Worldline Latvia SIA).
The Buyer shall receive the original invoice along with the ordered goods.
4. Provisions Stipulating the Delivery of the Orders
4.1. The delivery of the orders is possible through the courier service only. If the ordered goods are available in the warehouse, the Company shall ensure the delivery of the goods to all the Baltic countries within 3 (three) working days from the date when the Company received the full payment of its invoice from the Buyer.
4.2. If the ordered goods are not directly available in the warehouse, the Company shall ensure the delivery of the goods to the Buyer within 20 (twenty) working days from the date when the Company received the full payment of its invoice from the Buyer.
4.3. Latvia - Ordered goods shall be delivered within 3 working days upon payment of the invoice.
4.3.1. By choosing delivery of the goods to the address, the goods shall be delivered by courier service VAS "Latvijas Pasts", to the address specified by the customer. The cost of the delivery to the address - 5 EUR. The invoice amount will include the cost of the delivery - 5 EUR. The minimum amount of the order is not provided.
4.3.2. By choosing delivery of the goods to STATOIL DUS in Latvia, the ordered goods shall be delivered to the selected DUS within 3 business days and the customer shall receive the message about the receipt of the ordered goods. Service shall be provided by VAS "Latvijas Pasts". Delivery to STATOIL DUS is free of charge. The weight - up to 7kg. Minimum amount of the order - 40 EUR (with VAT).
4.3.3. Receipt of the goods in the office at Terbatas 14, office 303 - free of charge. When we receive the payment for the order, the employees of the company shall contact the customer and agree on the time of receipt of goods. The minimum amount of the order is not provided.
4.4. Delivery in the Baltic States - having received the payment of your order, it will be processed and sent by courier of VAS "Latvijas Pasts". The order shall be delivered within 3 days to Lithuania and Estonia. Price for delivery to Lithuania and Estonia - 10 EUR for coffee capsules and 15 EUR for combined orders. The minimum amount of the order is not provided.
5. Procedure of Making an Order of the Goods
5.1. The orders can be made 24 hours a day.
5.1.1. The Buyer should choose the goods, specify the required quantity and press "To Buy" button.
5.1.2. When all the goods are in the shopping basket, the Buyer should press To Proceed with the Payment. After that the Buyer shall be forwarded to the Summary of the Shopping Basket where he/she will have a possibility to make changes, i.e. to change the quantity of the goods or to delete the items from the list.
5.1.3. To proceed, the Buyer should fill in the form, providing his/her personal data, as well as the precise address for delivery of the goods.
5.1.4. When all the fields of the form are filled in, the Buyer should choose the payment method.
5.1.5. After the order has been successfully made, a confirmation of the order shall be sent to the Buyer’s e-mail address.
6. Return of the Goods
6.1. After the goods were delivered, they may be returned/exchanged for similar goods, if external mechanical damages (e.g. during the transportation by a courier) were found at the moment of reception of the goods. In this case, the Buyer shall have the duty to shoot the photos and immediately inform the employees of SIA "Kaffeks".
6.2. As a part of the sale of the warehouse, the original packaging of the coffee capsules has been damaged as a result of transportation, therefore, it has been replaced with an alternative packaging, for this reason the product is sold at a discount, it cannot be exchaged or returned.
7. Confidentiality Policy
7.1. The Company shall undertake not to disclose and not to pass any information about the Buyer to third parties without a written consent of the Buyer, excluding the cases of violation of the laws and regulations of the Republic of Latvia, as well as in the case of violation of this Contract.
All purchased coffee machines provide two-year warranty from the date of purchase. The nearest Nespresso® service is in Poland and the buyer should bear the dispatch expenses. The process of repair or replacement of the product with the same or the new one can take up to 30 days.
The absence of automatic dispatch confirmation means that the buyer has not fully completed the dispatch, or has provided the incorrect e-mail address, or the automatic notification went to Junk e-mail folder..
